TAXI LICENSING The Licensing of Drivers and Vehicles in the PH trade. 'Taxi' is a word often used incorrectly and inadvertently, when a person has a need to make such reference to calling for a 'Cab' or 'Hackney' or as in London a 'Mini-Cab'. (There are of course other interpretations of the word). Few if any people refer to calling for a 'Private Hire' car; do you wonder why? Like many words, both in this country and around the world, different words have different meanings. I am sure we all know what we mean when we wish to call for a .....................go on......say it.......Cab! The licensing of 'Taxi's' and Private Hire vehicles and drivers is the responsibility of local Authorities. The purpose of which is to ensure an element of regulation and control; the traveling public can therefore be assured in the knowledge of these regulations, their interest's are being met by a safe and reliable service. Drivers, and the vehicles they use are the subject of periodic checks, to ensure appropriate standards are maintained. DRIVERS: For instance, PH drivers apply to Nottingham City Council every year for a license (Badge) to drive.
VEHICLES: Vehicles licensed by Nottingham City Council are the subject of checks (more stringent than an MOT) on a six monthly basis. In addition, period checks (stop and check) are undertaken by the Nottinghamshire Police, in what are known as 'Taxi' checks, wherein qualified Police engineers then check vehicles over to ensure roadworthiness / presence of insurance etc.
The PH and Hackney trade's is governed by Act's of Parliament. The Town Police Clauses Act. 1847 & The Local Authority (Miscellaneous Provisions) Act. 1976 The above Act's form the main framework under which Local Authorities and the trade at large operate. (Unfortunately, like many Act's, they are out of date, and in need of serious review to reflect the requirements of a modern society and technology). LOCAL AUTHORITIES We have five Local Authorities within close proximity in South West Nottinghamshire with the responsibility of 'Taxi' licensing matters. Like all Local Authorities, decisions are, in the main, made in committee by local councilors, with guidance from Officers. This may account for variations in how the above Act's may be interpreted. Such variations may lead to differences in the standard of service provided by some local Private Hire companies. The following are the five LA's: Broxtowe BC Erewash BC Gedling BC Nottingham City Council Rushcliffe BC Enforcement Officers are employed by the Local Authorities; these Officers are empowered to oversee that standards are maintained; such enforcement frequently includes the Police, together with other individuals ensuring the trade operates within the law.
